Sam Altman has a dream. Not just to create the world's most powerful artificial intelligence, but to put it in your hands as a device. Something that could forever change how humans interact with artificial intelligence. Apple just filed a lawsuit that legal analysts say is designed to stop that dream before it ever hits a store shelf.
Last week, Apple sued GPT chat developer OpenAI, accusing it of stealing trade secrets. At first glance, this appears to be a legal dispute over employees who left Apple for Open AI and allegedly took confidential information with them. But AI commentator Shruy Mishra, in a detailed analysis published on X, argues that Apple has actually filed a lawsuit, which is something much more targeted and far more dangerous to OpenAI's ambitions.
According to her , Apple did not file a lawsuit, but simply performed an emergency shutdown function. Her argument is that this case is not really about the theft of a laptop or files downloaded from cloud storage. It's about one thing: preventing OpenAI's hardware from ever reaching a store shelf. At the center of the lawsuit is Tan Tan, OpenAI's chief hardware officer and former Apple senior executive.
He is named as the defendant. Apple alleges that Tan encouraged job candidates who were still employed at Apple to bring company equipment and information to interviews. According to the complaint, he asked candidates to bring real parts for display, batteries, logic boards and other components. Apple also claims that Tan used internal codenames for the company's projects during these interviews.
The second defendant, Jonglu, is accused of continuing to access Apple's cloud storage after leaving the company and downloading confidential documents while already working at OpenAI. But the most important part of this lawsuit is not the allegations themselves. This is what Apple is asking the court to do.
Apple is seeking a preliminary injunction , a court order that, if granted, could prevent OpenAI from developing its hardware program while the lawsuit is ongoing . Apple said it would take action quickly. Mishra's analysis of what this means for Open AI is unequivocal. The person who designs the device is the named defendant.
Every design decision in this program now carries a legal cloud that requires affirmative evidence to resolve, and litigation is not moving quickly. Interestingly, Apple in its complaint called OpenAI's hardware business rotten to the core . This wording lays the groundwork for the argument that no prohibition can be narrow enough, because the alleged contamination permeates the entire program, not just one person or one document.
This is legal language designed to make all hardware work legally toxic. Open AAI has already indicated in a separate court document that its hardware device is not expected before February 2027. These deadlines were ambitious. If Apple's request for an injunction is granted, those timelines could be significantly delayed, as each month of litigation adds delays to a product that has been out of reach of consumers for years.
Sam Allman has spoken publicly and enthusiastically about OpenAI's hardware ambitions . The idea of the first artificial intelligence-powered device, something that could redefine the personal computer category, as the iPhone once did, was central to where the company saw itself going. Apple, which created the category and jealously guards the expertise that made it possible, is now claiming in court that OpenAI built its hardware program on stolen knowledge.
Open AAI denies the allegations, but denials and legal outcomes are two very different things. We'll continue to follow this story, but share your thoughts in the comments below.
